Eric Howes is just the latest of spyware critics to receive a cease and desist from a company called Direct Revenue LLC. The story breaks at Broadbandreports where Eric mentions the problem surrounds MyPCTuneUp.com and Spyware Warrior. The C&D letter can be found here. Eric's response is located here. Of interesting note is the last paragraph in the response...


Spyware Warrior seeks only to offer consumers and citizens useful information about advertising software and the "anti-spyware" products available to remove such programs. Although we are always happy to correct information that is proven to be in error, Spyware Warrior will not hesitate to avail itself of any and all legal remedies to defend its right to publish such information, including but not limited to the State of California's "anti-SLAPP" law (see "Code of Civil Procedure," Section 425.10-425.16 a http://caselaw.lp.findlaw.com/cacodes/ccp/425.10-425.16.html), a statue which provides for strong penalties against those who seek to intimidate critics into silence.
There has certainly been a rift in 2005 where spyware critics are getting served C&Ds. Some of those are backing down, and others are not.

Is this not like a terrorist fighting for his American (not God) given rights to bare arms?

Terrorist-noun: The unlawful use or threatened use of force or violence or aggravasion by a person(s) or an organized group against people or property with the intention of intimidating or coercing societies or governments, often for personal profit, ideological or political reasons.

Why are the owners of these spyware companies not being dragged out into the streets and publicly executed for the terrorists they are? These spyware/adware/parasite persons are aggravating millions for sheer greed no matter what the cost.

The US does not need more laws or to waste more time and resources reviewing laws; the laws to combat the problem already exist. The US needs to act and remove this spreading disease of stupidity once and for all.

At the same time, you might as well line up the F.D.A., the A.M.A., Pharmaceutical Companies, Corporate Farms, the Tobacco Industry, the Big 3 Credit Industry, and our current war mongering coke addict terrorist leader, Bush.

Oh... but wait, if we executed all of the terrorist of this nation... we wouldn't really have an America anymore, would we?

How is it that these terrorists were not shot on sight and ever worse, ever allowed to gain positions of power?
Further, why are they allowed to continue in thier manupulation of laws and corruption of American ideals?

So really, what is one more terrorist group like spyware going to matter in the grand scheme of it all?

In 2002-2004 the US spent over 2 billion dollars in the war against SPAM (and related).
It is estimated the courts in 2005-2006 will spend over 8 billion in this so called war.
It only cost 15 cents for a bullet and these are terrorists!

I don't condone murder, but a timely spot of execution for a good cause is not such a bad thing.
When a person(s) can aggravate the lives of over 1,000 people and cost the courts more then a months labor and over a million dollars, really, is it not time to simply put and end to the problem?

Think about it... Years, billions of dollars, millions annoyed, in the case of some of those groups, millions killed/poisoned/deing; vs 15 cents and a public message that the people have had enough.
