This guy's only small fry, but complaints to the support desk, with follow up did the trick.
Freewebs currently showing the site as frozen.
Still trying to get his yahoo account suspended.

The quickest way to get a Yahoo account suspended is by reporting it via this web form http://help.yahoo.com/l/us/yahoo/mail/yahoomail/abuse.html
P.S. to check if a Yahoo account is still active or not, use

Seems Yahoo don't want to know about this issue.
First complaint was dismissed as being about spam, that they said did not originate from their network. Phooey, the complaint was about using @yahoo address for illegal activity. They can't (or won't) read.
Resubmitted complaint, get dodge and duck reply below. Again Yahoo can't (or won't) read.

http://nz.profiles.yahoo.com/puknz clearly proves that the address and Yahoo account in your message does exist.
The old report form had a selection where you specified what country was involved, and it would send the complaint to the appropriate local Yahoo abuse address.
Now with the new form it seems all is going to the Yahoo US address, and obviously the abuse desk there is not manned with the brightest crowd.
I will try and find the international form again (used to be http://add.yahoo.com/fast/help/us/mail/cgi_spam_intl until last week).

Large scale operations (like Yahoo!) get so many reports that they have to implement front-end robots to handle the 95% of mundane cases. These robots are programmed to scan the incoming message for
- the email address at Yahoo.* and do a quick lookup and response.
- the site name *.yahoo.* and again do a quick lookup and response.
In each case the response is a template as you have seen.
The trick is to get past the robot so that the message falls into the 5% category that gets queued to the superior human being. Try doing an "obfuscation" like
name {at} yahoo {dot} com - in this case
visiting our website:=20
http {colon} // www {dot} freewebs {dot} com / puknz
Sadly, I have learnt to think like a spammer
